Getting Divorced

You can get divorced in England or Wales if all of the following are true:

  • you’ve been married for over a year
  • your relationship has permanently broken down
  • your marriage is legally recognised in the UK (including same-sex marriage)

On the 6th April 2022 the law in England and Wales changed and the new no-fault divorce was introduced. The new law is set to end the ‘blame game’ and cut short lengthy separation periods. 

The new law also applies to civil partnership dissolution.

Civil Partnership Dissolution

You can apply to end (‘dissolve’) your civil partnership if you’ve been in the partnership for over a year. You must apply to a court to do this. However, you can usually avoid having to go to court if you can agree on the following:

  • Any arrangements for looking after any children
  • Any child maintenance payments for any children
  • The division of any money and property
  • The reasons for ending your civil partnership.
